Continuing Education of the Bar – California (“CEB” or “we”) is committed to ensuring the privacy of its customers and other visitors to its website and its paid content users. We have established this Privacy Policy (“Privacy Policy”) to demonstrate our commitment to fair information practices and to the protection of your privacy rights. This Privacy Policy governs CEB’s website, ceb.com, and its paid content services (collectively, the “Sites”). If you choose to use our Sites in any way, such as browsing or interacting, you agree with the terms of our current Privacy Policy as posted here. If you do not agree with this Privacy Policy, you should not use our Sites. We may update or modify this Privacy Policy from time to time at our sole discretion, and we will note the date of last update on the top of this page.

I. Types of Information Collected

CEB’s Collection of Information

We may collect certain types of information from our visitors, such as:

  • Contact Information such as name, address, city, state, ZIP code, email address and telephone number.
  • Account Information such as User ID and password.
  • Product Preferences
  • Content You Provide Voluntarily such as reviews, comments, state bar information, or any information you provide to us about your use of our products and services.
  • Financial and Payment Information such as payment card number, expiration date, delivery address, and billing address.
  • Usage Information such as the content and web pages you access.

When you access paid content on our Sites, we may collect information about the books and programs you access, the lectures you watch online, the courses you complete, and your participation in examination preparation discussion groups. If you choose to participate in activities on or connected with our Sites such as registrations, product reviews, contests, sweepstakes, questionnaires, surveys, service contacts, product purchases, or social media platforms, CEB will collect the personal information that you provide. We may enhance or merge non-personally identifiable and/or personally identifiable information that you provide to us directly with information from other sources, including offline resources and affiliated and unaffiliated third parties, for the purposes described below. All personally and non-personally identifiable information will be used solely for the purposes listed in this policy.

Tracking Technology

We may use certain technologies to collect other information from our visitors, including, but not limited to:

  • Traffic Data When you visit our Sites, we automatically track and collect the following categories of information: (1) your Internet protocol and domain server address; (2) the date and time of your visit to the Sites; (3) the type of web browser and operating system you used to access the Sites; (4) the web pages that you accessed at the Sites; (5) other information not identified or tracked to you personally such as searching (collectively “Traffic Data”). Traffic Data is anonymous information that does not identify or track you personally. We use Traffic Data to evaluate and improve the content of the Sites and to make the Sites more useful to visitors. We also use it to diagnose problems with our server, to keep our server running smoothly, and to monitor the number of visitors to the Sites and the type of technology they use.
  • Cookies A “cookie” is a small data file placed on your hard drive by an Internet website server. Our e-commerce provider, Fusebill, may use cookies in connection with e-commerce transactions to process your purchases. These cookies are governed Fusebill’s privacy policy https://www.fusebill.com/privacy-policy-fusebill, which we encourage you to review. CEB uses “temporary session cookies” to authenticate users and maintain the functionality of other online services. With the exception of your CEB account number, these “temporary cookies” contain no information that could personally identify you, and they exist only for the session in which you visit the Sites and are not stored. You can refuse to accept the cookie or delete it from your computer by using any of the widely available methods, but if you do so, you may be unable to purchase products and services from CEB online or otherwise access some of the interactive features of the Sites.
  • Tracking Code We may also track the pages you view on our Sites, links to and from our Sites that you click, emails that we send, or other online behavior on our Sites through methods such as tracking codes, customer relationship management and messaging software, web beacons, or pixels. These tools may be used to measure customer usage, prioritize the development of product features, enable customization or personalization,measure the popularity of our products by identifying which paid content is accessed most often, and the effectiveness of our email campaigns by identifying the individuals who open or act upon an email message, when an email message is opened, how many times an email message is forwarded, the type of software, device, operating system and browser used to access our website and content delivered through our website.
  • Mobile Devices If you access our Sites from a mobile device, we may collect data about the operating system on your device.

At this time, we do not honor “do not track” signals from website browsers. However, you may refuse or delete cookies. If you refuse or delete cookies, some of the functionality of our Sites may be impaired. If you turn off cookies, Web beacon and other technologies will still detect visits to our Sites, but the information they generate cannot be associated with other cookie information and are disregarded. Please refer to your browser Help instructions to learn more about how to manage cookies and the use of similar technologies.

II. Uses of Information Collected

CEB’s Use of Information

We may collect, maintain, and use your information for the following purposes:

  • Individual Accounts Your personal information is used to open, maintain, administer, and service your user profile, account or membership. CEB also uses personal information to authorize access to your personalized web pages on the Sites.
  • Services and Support CEB will use your personal information to respond to your inquiries or comments; to provide services, support, and CEB products to users, including contacting users when necessary; and to analyze and improve the Sites, including tailoring it to users’ preferences.
  • E-Commerce CEB uses personal information in connection with e-commerce transactions, including the processing, servicing or enforcing of transactions and sending related communications. Credit card transactions on the Sites are settled immediately through Fusebill, one of our e-commerce providers. Fusebill handles all traffic between the Sites, credit card issuers, and banks. Credit card information is used only for settling the funds needed for you to purchase our products and services. We do not store credit card information either on or outside the Sites. A digital certificate issued by Comodo, an internet security provider, verifies the identity of the site as a legitimate CEB e-commerce site.
  • Email From time to time, CEB may use your information to send you email messages or other marketing or promotional materials regarding current legal changes and updates or informing you of our products and services that we believe may be of interest to you, including announcements of new titles, upcoming MCLE programs, and special offers. If you do not wish to receive emails from CEB, follow the instructions contained in each email or please email us at customer_service@ceb.ucla.edu.
  • Marketing and Advertising We may use your information to market and advertise products and services of ours or of third party vendors via direct email or mail. Our mailings to you may also include information about similar products from select publishers. You may opt out of the marketing and advertising of our services at any time, by calling CEB Customer Service at (800) 232-3444, or emailing us at customer_service@ceb.ucla.edu with your request.
  • Other Uses CEB also uses personal information to authorize access to online services such as our paid content and to maintain the security and integrity of its systems. CEB may use your personal information to conform to legal requirements, comply with legal process, defend legal rights, or conduct investigations; or in connection with the sale or transfer of a business or in the event of a corporate change. CEB may track general activities such as searching, printing and search sessions.

Social Media Platforms CEB may have a presence on social media platforms such as Facebook, Twitter, and LinkedIn. Your participation with the services provided on social media platforms is voluntary. If you login to such services through an account you have with a third party social media platform, we may receive additional information from that other source such as your user name, stated location, date of birth, and interactions you have had on that third party social media platform. The personal information we may have access to would vary by social media platform and is controlled by privacy settings on that platform and your choices. Your use of services on third party social media platforms are governed by the privacy statement and other terms of use for that third party social media platform, until such information is shared with and collected by us, and then such information is also subject to this Privacy Policy.

User Choice Regarding Collection of Personal Information You may choose not to provide us with any personal information. If so, you will be able to access and use some portions of the Sites, but you will not be able to purchase CEB products and services or access those parts of the Sites that require you to Sign In using your personal User ID and password. IV. Sharing of Information

CEB may share your personal information with third parties such as affiliates, subsidiaries, service providers, vendors, and unaffiliated third parties for the uses described in this Privacy Policy, including the marketing of products. User(s) of our paid content services OnLAW and CEB Membership may also request aggregate data regarding their own statistical usage. CEB uses third parties to provide certain paid content on our Sites, such as MCLE programs and exam preparation courses. CEB may provide these third parties with your CEB account number for attendance purposes, and your contact information (such as first name, phone number, and email address) for technical support purposes. If requested, CEB may share information regarding MCLE records with the State Bar of California.

CEB does not sell, rent, exchange, or loan any personal information regarding its customers or other users of the Sites to any third parties, except as described in this Privacy Policy. We reserve the right to send you marketing information from ourselves or from third party vendors that is related to the services we are providing to you. We reserve the right to transfer personal information we have about you in the event we sell or transfer all or a portion of our business or assets. Should such a sale or transfer occur, we will use reasonable efforts to direct the transferee to use personal information you have provided to us in a manner that is consistent with our Privacy Policy. Following such a sale or transfer, you may contact the entity to which we transferred your personal information with any inquiries concerning the processing of that information. In addition, we may share your information if necessary to protect the safety, property, or other rights of us, our customers, or employees, or when otherwise required by law.

For jointly sponsored CLE programs, CEB may transmit registration information to the joint CLE-program sponsor, e.g., the State Bar of California, local bar associations, other bar-related organizations, such as the California Judges Association, or commercial CLE providers, but only as necessary for administration of the program. Such registration information may include personal information, such as your name, state bar number, address, telephone number, record of CEB products purchased as part of the joint sponsorship, or record of enrollments at CEB programs that are jointly sponsored.

Your personal and non-personal information will be stored in CEB databases (including local storage), which are located within the United States and Canada.

V. Security of Information

CEB has security measures in place to protect against unauthorized access, use, disclosure, or alteration of information under our control. These security measures include using a firewall to prevent unauthorized access to our systems and maintaining registration information on a server inaccessible to the public. Although CEB exercises reasonable care in providing secure transmission of information between your computer and our servers, CEB cannot ensure or warrant the security of any information transmitted to us over the Internet and accepts no liability for any unintentional disclosure.

VI. Collection of Information from Children

CEB does not intentionally collect personal information from children under 13 years of age, and children under age 13 should not submit any personal information to us. If we become aware that a child has provided us with personal information without parental consent, or a parent or guardian of a child contacts us through the contact information provided below, we will use reasonable efforts to delete the child’s information from our databases.

VII. User Ability to Access, Update, and Correct Personal Information

The personal information we collect is saved in a customer profile in industry-standard cloud storage. You can help us maintain the accuracy of your profile by notifying us whenever you change your law firm affiliation, address, telephone number, or email address. We maintain a procedure to help you confirm that your personal information remains correct and up-to-date. At any time, you may review and change your personal information by visiting https://research.ceb.com, logging in with your personally-created email address and Password, and accessing the Account functions, or by calling or emailing CEB Customer Service:(800)232-3444, 7:30am to 5:00pm (PT), M-F or customer_service@ceb.ucla.edu. After logging in to https://research.ceb.com, you may also review the record of your MCLE credits earned from attending CEB programs by accessing the Learning function. You may not correct MCLE credits yourself online, but you may ask for clarification or changes by calling or emailing CEB Customer Service as listed above. You may also access and change information about non-CEB courses you have attended through the same MyCEB MCLE function.

The Sites contain links to other third party websites. CEB is not responsible for the content or privacy practices of any other websites to which the Sites links. This Privacy Policy is applicable only to the Sites and not to any other websites that you may be able to access from the Sites, each of which may have data collection, storage, and use practices and policies that differ materially from this Privacy Policy. We encourage you to review the privacy policy for each such third party website.

IX. Updates and Changes to Privacy Policy

CEB reserves the right, at any time and without notice to you, to add to, change, update, or modify this Privacy Policy, simply by posting such change, update, or modification on the Sites. Any such change, update, or modification will be effective immediately upon posting on the Sites. If updated, the Privacy Policy will note the effective date of the update. Please check the effective date at the top of this page to determine if the policy has been modified since you last reviewed it. If CEB does make significant changes to its Privacy Policy, CEB will endeavor to post a statement to that effect on the Sites for at least two months from the effective date of the update; provided, however, that, the Privacy Policy as changed shall be effective despite any failure by CEB to post such a statement. Your continued use of any portion of our Sites following posting of the updated Privacy Policy constitutes your acceptance of the changes.
