CEB Publishes New Edition on Revocable Trusts in California

OAKLAND, CALIF.—Continuing Education of the Bar (CEB) announces publication of the new edition of Drafting California Revocable Trusts, the premier law book focused on community property held in trust in California. Completely revised and reorganized, the fourth edition contains vital new information and attorney-drafted forms for estate planning attorneys and others who work with revocable trusts, which have become the most popular estate planning tools in California.

Drafting California Revocable Trusts reviews the significant estate tax changes resulting from the Economic Growth and Tax Relief Reconciliation Act of 2001 (EGTRRA) and the major changes in California codes dealing with trusts.

"Responding to both the tax law uncertainties and the evolving substantive law changes, this fourth edition contains all new forms," says Hale Kronenberg, CEB Estate Planning Practice Group Manager. The new forms, which are also available on CD for an additional charge, emphasize:

  • Using a consistent document structure for both high-value and more modest estates
  • Placing all distribution provisions early in the trust document
  • Designing blocks of text in ways that make it easier to add or delete material such as the provisions for a QTIP trust or a trust for a minor beneficiary
  • Designing distribution provisions in ways that will minimize the need to completely overhaul trust documents in response to tax law changes
Formerly called Drafting California Revocable Living Trusts, this book also features:
  • Comprehensive discussion of the advantages and disadvantages of revocable trusts
  • Expanded analysis of tax considerations, including the generation-skipping transfer tax and changes in income tax brackets applicable to revocable trusts
  • Extensive citations to the newly promulgated Uniform Trust Act and the newly approved portions of the third edition of the Restatement of Trusts
  • Evaluation of alternative estate planning vehicles, such as wills, nonprobate transfers and powers of attorney
  • Tables of statutes, regulations, rulings, and cases
  • Related documents including pour-over wills
  • Complete sample trust documents

Drafting California Revocable Trusts (4th edition, 925 pages, 2 looseleaf volumes, December 2003) is available in CD/online format and can be purchased with a forms CD. For more information go to ceb.com.
